Sighs, Stress and a Serious Lesson in Workplace Discrimination

Imagine a high-stakes workplace, national security projects in the background, and one manager’s theatrical sighs taking centre stage. But this was no workplace comedy. It ended with a tribunal ruling for disability discrimination.

The claimant, an employee with ADHD, became the focus of repeated criticism and what the tribunal described as non-verbal frustration (eye rolls, exaggerated sighs and pointed silence). Importantly, this behaviour was only directed at them.

The manager admitted he was under pressure and struggling to provide the necessary support or adjustments. But instead of seeking help, he told the claimant they were becoming a "net detriment" and joked about "putting their ADHD aside for a moment". The claimant went on sick leave in 2023 and never returned. They were later dismissed.

The tribunal ruled in the claimant’s favour. The judge made it clear that reactions from colleagues, even silent gestures, can have a damaging impact on someone’s mental health and self-esteem. If the manager had taken early steps to understand the claimant’s needs and provide appropriate support, the entire situation might have been avoided.
